Article I. Name |
|
| |
|
|
| |
Section 1. |
|
| |
The name of this organization shall be San Jose State University Wrestling Club, hereafter referred to as SJSU
WC. |
|
| |
|
|
| |
Article II. Purpose |
|
| |
|
|
| |
Section 1. |
|
| |
The purpose of the SJSU WC is to provide an outlet for students to participate in various styles of amateur wrestling
to enhance and learn new techniques to better their fundamentals of wrestling; to garner better conditioning to
enhance their health; to meet new friends and share camaraderie with other students, both at SJSU and other colleges/universities,
to enrich their overall college experience. |

Article III. Affiliation |
|

|
|
| |
Section 1. |
|
| |
SJSU WC is affiliated with USA Wrestling (USAW), the
organizing body of amateur wrestling for the United States. This affiliation provides insurance for SJSU WC. In
addition, membership in USAW is a requirement for SJSU WC members to participate in USAW sanctioned events. |
|

|
|
| |
Article IV. Membership |
|
| |
|
|
| |
Section 1. |
|
| |
Any student who conducts themselves in a reasonable and polite manner and who is in relatively stable condition
for rigorous exercise, regardless of race, religion, gender, year in school or age, is eligible to be a member
of SJSU WC. Adherence to safety precautions, attention to instruction and friendship to fellow team members and
staff is required at all times. |

Section 2. |

Voting membership is restricted to matriculated, currently enrolled students, faculty and staff at San Jose State
University. |
|
| |
|
|
| |
Section 3. |
|
| |
At least eighty percent (80%) of all members of the organization are matriculated, currently enrolled at San Jose
State University. |
|
| |
|
|
| |
Section 4. |
|
| |
Membership in the organization will not be denied to anyone on the basis of race, religion, national origin, age,
sex, disability, veteran's status, or sexual orientation, except as sanctioned by law (California Administrative
Code, Title 5, Section 41500; Education Amendments of 1972, Title IX. |
|

|
|
| |
Section 5. |
|
| |
There shall be no hazing. |
|
| |
|
|
| |
Article V. Officers |
|
| |
|
|
| |
Section 1. |
|
| |
The officers of this organization shall be President, Vice President and Secretary. |
|
| |
|
|
| |
Section 2. |
|
| |
Term of office shall be from the time of election new officers take office immediately following the next election.
Term of office shall be one year. |
|
| |
|
|
| |
Section 3. |
|
| |
Should the President vacate his/her position prior to the end of his/her term, it will be immediately filled by
the Vice President; Should the Vice President vacate office prior to the end of his/her term, that office shall
remain vacant until the next election; Should the Secretary vacate his/her office prior to the end of his/her term,
and if the President and/or Vice President cannot handle the Secretary's responsibilities, a new, special election
will take place. In the event of a special election, the term is valid only for the remainder of the current term. |

Section 4. |

All officers of this organization are matriculated, currently enrolled at San Jose State University. |
|
| |
|
|
| |
Article VI. Duties of Officers |
|
| |
|
|
| |
Section 1. |
|
| |
President - Conducts and leads all club warm up activities, assist Head Coach with motivational speeches to prepare
club for competitions. |
|
| |
|
|
| |
Section 2. |
|
| |
Vice President - Assists President with warm up activities prior to and at the end of each practice and provides
motivation activities when needed or asked upon from the Head Coach or the President. Leads club warm ups when
President is not available. |
|
| |
|
|
| |
Section 3. |
|
| |
Secretary - Provides appropriate communications to the club, in coordination with club officers and Head Coach.
Alternate for leading club warm ups and motivation when President and Vice President are not available. |
|
| |
|
|
| |
Article VII. Nominations and Elections |
|
| |
|
|
| |
Section 1. |
|
| |
All voting members of the club can nominate any individual of the club who is in good standing for any of the officer
positions. However an individual can only run for one office per election. The individual nominated must accept
the nomination prior to the club being notified of his/her candidacy on the ballot. Nominations will commence at
the first official club meeting of the Fall Semester. |
|

|

Section 2. |
|
| |
Elections will take place at the beginning of the Fall Semester, no later than two weeks following nominations. |
|
| |
|
|
| |
Section 3. |
|
| |
Officers will be elected by a vote of plurality, those candidates receiving the most votes in each officer category. |
|
| |
|
|
| |
Article VIII. Meetings |
|
| |
|
|
| |
Section 1. |
|
| |
Meetings/practices will take place a minimum of twice a week and as often as six times a week, depending on competition
schedule, upcoming tournaments and workout room availability. |
|
| |
|
|
| |
Section 2. |
|
| |
Special meetings can be called by any of the elected officers, with the understanding that all members must be
informed of such a meeting. |
|
| |
|
|
| |
Section 3. |
|
| |
A quorum consists of a minimum of four members to have a practice. To vote, a quorum consists of two-thirds (66
2/3%) of total membership. |
|
| |
|
|
| |
Section 4. |
|
| |
The parliamentary authority of this organization shall be Robert's Rules of Order, Revised. |
|
| |
|
|
| |
Article IX. Committees |
|
| |
|
|
| |
Section 1. |
|
| |
The Head Coach and the President are the only people who have authorization to name committees. |
|
| |
|
|
| |
Article X. Dues, Fees |
|
| |
|
|
| |
Section 1. |
|
| |
Dues are to mirror association dues to USAW. Participation tournament fees will be stipulated by those institutions
hosting said tournaments SJSU WC participates in. |
|
| |
|
|
| |
Article XI. Amendments |
|
| |
|
|
| |
Section 1. |
|
| |
Any member in good standing can originate an amendment and present to the club. |
|
| |
|
|
| |
Section 2. |
|
| |
The amendment must be presented when a quorum is present at any club practice or meeting and distributed to all
members in good standing. A minimum of a two week gestation period must transpire before presented amendment can
be voted upon. |
|
| |
|
|
| |
Section 3. |
|
| |
A minimum of two-thirds (66 2/3%) of the total membership in good standing must pass the proposed amendment to
become accepted. The Secretary must immediately issue minutes to the entire membership in good standing on the
outcome of proposed amendment. If approved, either Head Coach or Secretary must incorporate into Club Charter and
distribute amended Charter to entire membership in good standing. |

The approved amendment becomes official when elective action is sent via minutes to the entire membership in good
standing. |
|

|
| |
This club constitution was approved and accepted by SJSU WC on December 3, 2001 |
